These Terms and Conditions (“the Terms and Conditions”) govern your (“the User”) use of the Natalie Jane Photography (“Provider”) website located at the domain name www.nataliejanephotos.co.uk (“the Website”). By accessing and using the Website, the User agrees to be bound by the Terms and Conditions set out in this legal notice. The User may not access, display, use, download, and/or otherwise copy or distribute Content obtained on the website for marketing and other purposes without the consent of the Provider.
The provider is not responsible for any malicious software or viruses suffered through the use of the website.
Users are prohibited from copying any content or image(s) from the website without prior written consent from the provider.
Use of website constitutes automatic acceptance of the agreement within the terms of use and service.
Definitions
For the purposes of this agreement 'The Photographer' is Natalie Jane trading as Natalie Jane Photography and 'the Client' is any individual, firm or company commissioning the work and/or engaging the services by the photographer. 'Images' means all photographic material created by the photographer, including but not limited to photographs, prints or any other of physical or electronic material, i.e digital file/images.​
Copyright and Usage
The photographer, Natalie Jane retains copyright of all image and footage create. Clients must not reproduce or copy image or footage without prior written permission from the photographer. Client acknowledges that Photographer is the Author of the Image(s) and also the first and sole owner of all copyrights of the Image(s). The Image(s) and all copyrights remain the exclusive property of Photographer without limitation.
Use of images or footage for commercial purposes without permission is subject to additional fees and damages. Any additional usage beyond initial agreement upon quoting is subject to new permissions and may incur extra charges.The Photographer reserves the right to use images and footage for promotional, marketing and editorial purposes.
Limitation of Liability
(1).The photographer will take all reasonable care in production of the image(s) and the performance of this agreement. The photographer will not be liable for any loss damages or costs suffered by the Client or any third party arising from Client's use of any image(s).
(2).The photographer is only viable for damage that were caused intentionally or through gross negligence herself.
(3).The photographer is not liable for defects that can be traced back to incorrect or imprecise instructions from the client.
(4). In the case of defectiveness, the client is only entitled to a claim for improvement by the photography. If an improvement is impossible or if it is rejected by the photographer, the client is entitled to a price reduction. No liability is assumed for insignificant defects. Colour differences in repeat orders are not considered a significant defect.
(5). In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.​
Governing Law
This agreement shall be governed and construed in accordance with the Laws of England.
